Macy's, Martha, J.C. Penney Back in Court

NEW YORK-The trial over the lawsuits by Macy's against Martha Stewart Living Omnimedia and J.C. Penney resumed this morning.
Macy's filed lawsuits against both MSLO and J.C. Penney last year over MSLO's agreement with J.C. Penney to open Martha Stewart home shops in J.C. Penney stores and create a website dedicated to this program. On March 8, Justice Jeffrey Oing of the New York State Supreme Court, who is hearing the cases, told all three parties to try to settle the matter through mediation, and directed them to reappear in his court today if mediation was unsuccessful. At that time, according to press reports, J.C. Penney agreed not to sell any products designed by Stewart in Macy's exclusive categories until today.
